Welcome to Memorial (“we,” “our,” or “us”). These Terms of Service govern your access to and use of our platform, including the website, dashboard, memorial pages, AI card generation tools, template editor, and all related features (collectively, the “Service”).
You must be at least 18 years old to create an account. By using Memorial, you represent that you meet this requirement and that all information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@memorial.app if you suspect unauthorised access.
Memorial allows you to create digital memorial profiles and print-ready funeral cards. You retain full ownership of the original content you upload (photos, text, videos). You grant Memorial a limited, non-exclusive licence to store, display, and process that content solely to provide the Service to you.
All templates, design assets, AI models, and platform code are owned by Memorial or its licensors. You may not reproduce, resell, or distribute our templates or design elements outside the platform without written permission.
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from your dashboard settings. Upon deletion, your data will be removed in accordance with our Data Retention policy below.
The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation of the platform.
To the maximum extent permitted by applicable law, Memorial shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

Our platform offers optional AI-powered tools to help you write obituaries, tribute messages, and card text. The following applies to all AI-generated content:
Content generated by our AI tools and then edited or published by you is treated as your content. You retain full rights to it once exported or saved. We do not claim ownership of AI outputs.
AI-generated text is a starting point. You are responsible for reviewing, editing, and verifying all content before publishing or printing. Memorial is not liable for inaccuracies in AI-generated text.
Information you provide to generate AI content (names, dates, descriptions) is used only to produce that specific output. We do not use your personal memorial details to train our AI models.
AI features are entirely optional. You can create, customise, and publish memorials and cards without using any AI tools at any time.
Memorial offers free access to a selection of templates and one memorial profile. Premium plans unlock unlimited memorials, premium template designs, advanced AI tools, and priority support.
Premium subscriptions are billed monthly or annually. All payments are processed securely through our payment provider. We do not store your full card details on our servers.
We offer a 7-day refund policy on new subscriptions if you are not satisfied. One-time card purchases or individual template downloads are non-refundable once the file has been downloaded.
You may cancel your subscription at any time from your account settings. Access continues until the end of your current billing period. No prorated refunds are issued for partial billing periods.
Your family’s privacy is our highest priority. This Privacy Policy explains what data we collect, how we use it, and your rights regarding that data.
We never sell your personal data or memorial content to third parties.
Memorials are private by default. Only people you explicitly invite via a private link can view a memorial. You can adjust sharing settings at any time from your dashboard.
We retain your data for as long as your account is active. When you delete your account, all personal data and memorial content is permanently removed from our servers within 30 days, except where retention is required by law.

All data transmitted between your browser and our servers is encrypted using TLS (Transport Layer Security). Stored files — including photos and videos — are encrypted at rest.
Access to production data is restricted to authorised personnel only, protected by multi-factor authentication and audited regularly.
We use trusted third-party services including secure cloud storage and payment processors. Each provider is GDPR-compliant and bound by data processing agreements.
In the unlikely event of a data breach affecting your personal information, we will notify you within 72 hours of becoming aware, as required by applicable regulations.
Memorial content is backed up daily. In the event of data loss, we will make every effort to restore content from the most recent backup.
